Our Terms

Scope:

These terms and conditions apply to all deliveries from Catering & Event Services GmbH to customers.
An exception to this scope only exists to the extent that written agreements between customers and Catering & Event Services GmbH expressly provide for something different.
Oral agreements have no legal effect. These terms and conditions take precedence over any purchasing conditions of the customer.

Bills:

Our invoices are due without deductions within 10 days of the invoice being issued. Any deductions will be subsequently debited.
If payment is not made on time, we will incur inconveniences and you will incur further costs amounting to at least 10 CHF plus late payment interest of 7.25%. 
Information about payment processing can be forwarded to the Swiss Association Creditreform.

Jurisdiction:

The place of jurisdiction is Zurich, Switzerland.

Rental Conditions

Conclusion of the contract

1. The presentation of our product range at www.catering-miete.ch does not constitute a binding offer in the legal sense, but is non-binding and subject to change.
2. After receiving the request, we will provide the customer with an initial offer, in which the availability of the goods is not guaranteed.
3. By returning the signed offer, the customer places a binding order.
4. The rental agreement is concluded when the rental agreement is delivered by post or electronically.

Prices

Our rental prices include provision and cleaning in our warehouse, exclusive of VAT, transport and insurance. Our rental prices are always for three days or a weekend. Longer rental periods on request.

delivery

Delivery takes place to the delivery address specified by the customer on the agreed delivery date. Delivery is made to the best of our knowledge and belief and in compliance with the relevant legal regulations. With every delivery, time differences must be taken into account, which we cannot influence even if we take great care. Promised appointments are only guaranteed under the condition of normal operations. In cases of force majeure, the client assumes any additional costs for personnel and materials resulting from waiting times. The customer guarantees receipt of the goods and rental accessories ordered by him and acknowledges the proper receipt of the goods, rental accessories and services ordered in his order on the delivery note handed out by the delivery staff. If the customer is not at his place during delivery, he agrees that the driver will deposit the goods on site. In this case, the customer declares that he accepts liability from the point of unloading. If the customer is not at the place when the goods are taken back and the goods cannot be reached under reasonable conditions, the landlord will collect them again later at additional costs for the tenant. Special features that affect the delivery location, such as paths that are not wheelchair accessible or upper floors without an elevator, must be communicated by the customer when ordering so that we can prepare for this in terms of time and organization. For particularly complex circumstances regarding the delivery location, we reserve the right to charge a flat rate for additional expenses.

Breakage, loss, damage and late return

The customer is responsible for our rental goods from the time they are picked up until they are returned. The return is initially subject to reservation. Exact breakages and missing quantities can only be determined after the cleaning process has been completed. Any breakage, loss or damage will be offset against the new price, or the repair costs will be invoiced to the customer by Catering & Event Services GmbH. A third-party replacement will not be accepted. For goods returned late, the tenant owes a minimum of the rental price for a further rental period. The customer bears any costs for a new journey (if delivery), replacement procurement and all related activities.

Liability

Our liability within the scope of the agreed services is limited to the value of the goods. After the ordered goods and rental goods have been handed over to the customer, liability for damage passes to the customer.

warranty

We ensure that the goods to be delivered are transported carefully and in accordance with regulations. The customer must inspect the goods with the level of thoroughness that is reasonable for him and confirms the accuracy by signing the delivery note. Identifiable defects or complaints relating, for example, to the number and quantity of goods ordered can only be asserted immediately after delivery and must be noted immediately on the delivery note.
If there are demonstrable defects, we can, at our discretion, repair the goods or provide a replacement product free of charge. The right to change or reduction does not apply if any defects or reduced performance are not complained about until later.

Cancellation/cancellations

Cancellations must always be made in writing.
If an order is canceled after the order has been placed, the following costs will be charged:
Any planning costs and preparatory work more than 30 calendar days before delivery.
Less, equal to 30 calendar days before delivery 25% of the agreed services
From 15 calendar days before delivery, 50% of the agreed services
from 5 days before delivery 100% of the agreed services

Retention of title

In any case, all rental material remains the property of the respective landlord/Catering & Event Services GmbH.

Due to currency fluctuations and increasing transport costs, we reserve the right to change prices at any time.
